A California judge overseeing a group of seven DePuy ASR hip replacement lawsuits has agreed to allow plaintiffs with Pinnacle complaints to join the multicounty litigation (MCL) being overseen in a state court. The decision was reported by the medical device news Web site, MassDevice.com, on July 26, 2013.
Judge Permits Joint Motion
After forming an MCL consisting of DePuy ASR complaints, the Honorable Richard Kramer, a judge in the Superior Court of California in San Francisco, agreed to allow Pinnacle plaintiffs to add their lawsuits to the group. A multicounty litigation is similar to a multidistrict litigation (MDL), which consolidates lawsuits filed in federal district courts nationwide. The process maintains the individuality of each lawsuit, but speeds up pretrial matters, allowing the cases to reach the trial phase of litigation more quickly. An MCL works similarly, but with cases that are filed in state courts. This process is popular when contending with a large number of personal injury lawsuits, as is the case with the thousands of DePuy Pinnacle and ASR cases that have been filed in state and federal courts across the country. There are currently MDLs underway for both Pinnacle and ASR plaintiffs, with several of the ASR cases having recently gone to trial. Cases that are part of the Pinnacle MDL are scheduled to go to trial in late 2014.
