The cases against DePuy Orthopaedics, a division of Johnson & Johnson, continue to mount as more lawsuits continue to join the Pinnacle hip replacement multidistrict litigation underway in the U.S. District Court for the Northern District of Texas. The latest has been filed by Tina Miller, who is currently awaiting revision surgery to replace a defective Pinnacle implant.
Plaintiff Alleges Symptoms of Metal Poisoning, Pain, and Grinding
In 2007, Ms. Miller was implanted with a Pinnacle hip replacement device. She claims that in recent months, she has experienced serious complications such as severe pain, feeling a grinding sensation, and hearing popping noises. She is also suffering from symptoms of metal poisoning, known as metallosis, as a result of microscopic particles that shed from the implant. Ms. Miller claims the device is interfering with her daily activities and reducing her quality of life. She seeks $5 million for “possible permanent injuries, economic loss, disfigurement, disability, and emotional distress.”
Moreover, Ms. Miller’s complaint alleges that DePuy concealed from the medical community, and consumers, “known defects, early failure rate, and unreasonable risks of having the device implanted.” The lawsuit also states that the company continued to aggressively market the Pinnacle as a superior alternative for patients who sought to maintain an active lifestyle post-surgery. The company also claimed that the device would last longer than other available hip replacement implants.
